Liability: What the Company Does Not Own

The Company and all affiliated service providers assume zero liability for the following categories of loss, damage, or consequence:
Pre-existing structural conditions. Hoarding environments frequently conceal compromised flooring, load-bearing wall damage, pest infestation, mold colonization, and compromised mechanical systems. The Company accepts no responsibility for any structural deficiency discovered during or after cleanup operations, regardless of when the damage originated or how it is characterized by a third party.
Undisclosed or unidentified hazards. Clients are required to disclose all known biohazards, chemical agents, controlled substances, sharps, biological matter, and environmental contaminants prior to crew deployment. Any undisclosed hazard — whether unknown to the client or deliberately withheld — releases the Company and its providers from all liability arising from exposure, regulatory violation, remediation cost escalation, or bodily harm to any party.
Authorized item disposal. When a client grants authorization — verbally, in writing, or by signature on a work order — to remove, destroy, or dispose of any item or category of items, that authorization is final. The Company bears no liability for the permanent loss of any authorized item, including items of sentimental, financial, or legal significance. Clients are solely responsible for identifying and segregating items they wish to retain before work begins.
All service is rendered on an as-is, where-is basis. No warranty, express or implied, attaches to any service outcome.
Environmental Compliance — Indiana Standards
The Company conducts biohazard remediation and waste disposal in formal adherence to regulations set forth by the Indiana Department of Environmental Management (IDEM). This includes applicable standards governing the handling, transport, and disposal of biological waste, chemical contaminants, and regulated solid waste streams. Client Obligations Before Service Begins
You must provide accurate site access. Crew delays caused by locked premises, unannounced pets, absent keyholders, or restricted access points may result in a trip charge billed at the Company’s current rate. You must identify and physically separate any items you do not authorize for removal. You must disclose all known hazards in writing before the crew arrives. Failure on any of these points shifts full liability to the client for resulting costs, delays, or injuries.
Scheduling, Cancellation, and Rescheduling
Service appointments confirmed through this portal require a minimum of 48 hours advance notice for cancellation or rescheduling without penalty. Cancellations inside 48 hours may incur a cancellation fee. Same-day cancellations — meaning notice given on the day of scheduled service — will be charged at the full crew mobilization rate. The Company reserves the right to reschedule any appointment due to crew availability, weather, or site safety concerns without financial penalty to either party.
Promotional Vouchers and Gift Cards
Any gift card, promotional voucher, discount code, or stored-value instrument issued in connection with hoardingcleanupjasper.com carries a cash value of $0.00. These instruments are entirely non-refundable under all circumstances. No cash equivalent will be provided upon request, expiration, or non-use. All promotional vouchers and gift cards issued through this portal are completely void within the State of California and may not be redeemed, transferred, or applied toward any service by any California resident or within California jurisdiction.
Third-Party Contractors
Field crews dispatched through this portal may be independent contractors rather than direct employees of the Company. The Company is not liable for the independent acts, errors, or omissions of third-party crew members operating outside the scope of their assigned work order. All crew members are vetted and coordinated through the Company’s dispatch system, but independent contractor status limits the Company’s vicarious liability as permitted under Indiana law.
Dispute Resolution and Governing Law
These terms are governed exclusively by the laws of the State of Indiana. The client waives any right to bring claims in any other venue. Class action participation and class-wide arbitration are expressly waived to the fullest extent permitted by law.
